These Terms of Service (“Terms”) govern your use of the Foremost mobile application and related services (“Foremost” or the “Service”), operated by Roman Gurov, an individual based at Tirta Property, Petulu, Ubud District, Gianyar Regency, Bali 80571, Indonesia (“we,” “us,” or “our”).
By downloading, accessing, or using Foremost, you agree to these Terms. If you do not agree, do not use the Service.
1. What Foremost Does
Foremost is a productivity application that lets you select applications or categories on your Apple device and apply scheduled access controls to them. Depending on the mode you choose, selected applications may remain unavailable during a schedule, become available for a limited number of timed sessions, or remain unavailable while tasks are unfinished.
Tasks may be maintained directly in Foremost, synchronized with Todoist, or accessed through Apple Reminders. Foremost is intended as a personal follow-through tool. It is not parental-control software, medical treatment, emergency software, or a guarantee that distractions will be prevented or tasks will be completed.
Some features require compatible Apple hardware and software, Apple Family Controls authorization, Reminders permission, an internet connection, or an account with a third-party service.
2. Eligibility
You must be at least 16 years old and legally capable of entering into these Terms. If the law where you live sets a higher age for entering into these Terms, that higher age applies.
You may use Foremost only in compliance with applicable law and the rules that apply to your Apple account, device, and connected third-party services.
3. Your Account
Foremost currently uses Sign in with Apple. You are responsible for maintaining control of your Apple account, device, and authentication credentials and for activity performed through your Foremost account.
You must provide accurate information and must not access another person’s account without authorization. If you believe your account or device has been compromised, contact us at rgurov@yahoo.com.
Foremost may store your authenticated session on your device so that you remain signed in.
4. Device Controls and Permissions
You choose which applications or categories Foremost manages and when its schedules apply. You are responsible for reviewing those choices before enabling a block list.
Foremost relies on Apple’s Family Controls, Managed Settings, Device Activity, and related operating-system behavior. Device controls may be delayed, interrupted, removed, or operate differently because of denied permissions, operating-system restrictions, software updates, invalidated application tokens, entitlement state, background execution limits, device settings, or circumstances outside our control.
You should not rely on Foremost where failure to block or restore access could cause personal injury, property damage, financial loss, missed emergency communications, or another serious consequence. You remain responsible for your device use, task completion, schedules, and access to other applications.
5. Your Tasks and Connected Services
You retain any rights you hold in task titles and other information you enter into Foremost or choose to access through a connected service (“Your Content”).
You authorize us to process Your Content only as reasonably necessary to provide the Service, including storing manual tasks on your device and transmitting task changes to a connected Todoist account or Apple Reminders list when you choose those sources.
You represent that you have the right to provide and use Your Content in this way. Do not enter content that is unlawful, infringes another person’s rights, contains malicious code, or is intended to misuse the Service.
Foremost is not a backup service. Manual tasks, block lists, schedules, and integration settings may be stored only on your device, and signing out, deleting your account, deleting the application, losing the device, or clearing its storage may permanently remove them.
6. Acceptable Use
You may not:
- use Foremost for an unlawful or fraudulent purpose;
- attempt to access another person’s account, tasks, reminders, or connected services without authorization;
- interfere with, overload, probe, or circumvent the security of Foremost or its supporting systems;
- reverse engineer or modify Foremost except where applicable law expressly permits it;
- use Foremost to infringe intellectual-property, privacy, or other legal rights; or
- use automated means to access the Service in a manner that materially disrupts it.
Foremost does not currently operate a public-content moderation system. These restrictions are contractual obligations and do not imply that we monitor all activity.
7. Free Access and Foremost Pro
Foremost may provide a limited period of access to its device-control functionality after onboarding. The current application is designed to provide a 24-hour access period, but this in-app access period is separate from any free trial or introductory offer displayed by Apple.
Continued access to paid functionality may require the “Foremost Pro” entitlement. Available products, prices, billing periods, and purchase terms are shown in the App Store purchase interface before you confirm a transaction. Those details form part of your purchase terms.
If you purchase an auto-renewing subscription, it renews according to the period and price disclosed by Apple unless you cancel it through your Apple account before renewal. Apple processes payments and manages subscription billing. Refund requests and billing disputes are handled under Apple’s applicable policies and mandatory law.
You can use the purchase-management and restore options provided in Foremost. Deleting your Foremost account or removing the application does not cancel an active subscription. You must cancel it separately through Apple.
We may change which features are included in free or paid access for future use, but changes do not alter a purchase period you have already paid for except as allowed by the applicable store terms and law.
8. Third-Party Services
Foremost depends on or may connect with services provided by Apple, Todoist, Supabase, RevenueCat, and PostHog.
If you connect Todoist, you authorize Foremost to read and modify tasks within the access scope you approve. If you connect Apple Reminders, you authorize Foremost to read and modify reminders in the list you select. Actions you take in Foremost, such as creating, renaming, or completing a task, may change data in the connected service.
Your use of Apple, Todoist, and other third-party services remains subject to their own terms and privacy practices. We do not control and are not responsible for the availability, security, pricing, policy changes, or independent conduct of those services.
Disconnecting an integration removes its Foremost configuration from the device but does not necessarily delete information already stored by the third-party provider.
9. Foremost Intellectual Property
Foremost, including its software, design, graphics, branding, and other materials excluding Your Content and third-party materials, is owned by us or our licensors and is protected by applicable intellectual-property laws.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Foremost on compatible devices you own or control for personal use. No other rights are granted.
Apple and Todoist names, marks, and services belong to their respective owners. Their availability in Foremost does not transfer ownership or imply sponsorship beyond the applicable integration relationship.
10. Service Changes and Availability
Foremost is available worldwide.
We may maintain, update, change, or discontinue parts of Foremost. We do not promise that the Service, any integration, or device-control behavior will always be available, uninterrupted, timely, secure, or error-free.
Updates to Apple operating systems, Family Controls, Todoist APIs, RevenueCat, Supabase, PostHog, or other dependencies may affect Foremost. You may need to install updates, grant permissions again, reconnect an integration, or recreate a block list.
11. Disclaimers
To the maximum extent permitted by law, Foremost is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that Foremost will block every selected application at every scheduled moment, restore access at an exact time, accurately reflect every external task immediately, prevent circumvention, improve productivity, or produce any particular personal outcome.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
12. Limitation of Liability
To the maximum extent permitted by law, Roman Gurov and any contractors or licensors involved in providing Foremost will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, opportunity, productivity, or access to another application, arising from or related to Foremost.
To the maximum extent permitted by law, our total liability for all claims arising from or related to Foremost will not exceed the greater of the amount you paid for Foremost during the 12 months before the claim or US$100.
These limitations apply regardless of the theory of liability and even if we were advised that damage was possible. They do not limit liability that cannot lawfully be excluded or limited.
13. Ending Your Use
You may stop using Foremost at any time. You may sign out or request account deletion from Settings.
Signing out removes Foremost block lists, schedules, manual tasks, and connected-task configuration from that device. Account deletion also requests deletion of your Foremost authentication account. Local cleanup is performed on a best-effort basis, and data held independently by Apple, Todoist, or another provider remains subject to that provider’s controls.
Account deletion does not cancel an App Store subscription.
We may discontinue the Service or restrict access where reasonably necessary to comply with law, respond to a security threat, protect the Service from material interference, or address a violation of these Terms.
Sections that by their nature should survive termination—including intellectual-property, disclaimer, liability, and dispute provisions—will survive.
14. Changes to These Terms
We may update these Terms to reflect changes to Foremost, applicable law, or our business. We will post the updated Terms and revise the effective date. If a change materially affects your rights, we will provide reasonable notice through the Service or another appropriate method.
Your continued use after updated Terms take effect means you accept them. If you do not agree, you must stop using Foremost.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-laws principles.
Unless mandatory law gives you another right, courts with competent jurisdiction in Gianyar Regency, Bali, Indonesia will have exclusive jurisdiction over disputes arising from or related to these Terms or Foremost.
Nothing in these Terms limits consumer rights that cannot be waived under the law where you live.
16. Apple-Specific Terms
Apple’s Standard Licensed Application End User License Agreement applies to your license to use the Foremost application. These Terms govern the related Foremost service and supplement that agreement. If these Terms conflict with Apple’s Standard EULA on a matter concerning the application license, Apple’s Standard EULA controls.
These Terms are between you and Roman Gurov, not Apple. Apple is not responsible for Foremost or its support, maintenance, warranties, or claims, except as required by Apple’s terms or applicable law.
